Terms of Service

Vodach ("the App", "we") is a mobile and web app for hiking in Bulgaria. These terms govern your use of it. By creating an account or using the App you accept them. If you do not, please do not use the App. How we handle personal data is covered separately in our Privacy Policy. Vodach is built and run by two private individuals, not a company; write to [email protected] about anything here.

1. The mountain is the risk, and it is yours

Vodach does not replace your own judgement, a map, a compass, or being prepared. Hiking, and mountain terrain in particular, carries a risk of injury and death. You decide whether to set out, which route to take, and when to turn back. That decision is always yours and you are responsible for it.

Do not rely on the App as your only means of navigation or as a safety device. Phones run out of battery, lose signal, get wet and break. GPS accuracy varies with terrain and weather; recorded tracks, distances and elevation are estimates, not measurements. Barometric altitude, offline maps and terrain data can all be wrong or stale. Weather information comes from third parties and can be outdated.

Route difficulty, duration and condition are indicative. Trail reports describe what somebody saw at one moment in time and may no longer be true. A route that was passable last week may not be today. Places, trails and geographic data come from OpenStreetMap, from other users and partly from AI-written descriptions, and are offered as-is — we do not warrant that any of it is complete, current or correct.

Emergency contacts and live location sharing are convenience features. They depend on network coverage and on third-party delivery, so never treat them as a rescue mechanism. In an emergency call 112.

2. Your account

You need an account for most features. You must be at least 16 years old — the same threshold as in our Privacy Policy. Keep your password to yourself; you are responsible for what happens under your account. Give accurate information, and one account per person.

We may suspend or close an account that breaks these terms, abuses other users, or manipulates the App's data or scoring.

3. What you contribute

Reports, reviews, photos, trails and routes you submit stay yours. By submitting them you give us a non-exclusive, worldwide, royalty-free licence to store, display and distribute them inside the App and its community features, including after you stop using the App where the content has become part of shared community data (for example a trail others now walk). Delete your account and we remove or anonymise your contributions as described in the Privacy Policy.

Do not submit: content that is unlawful, hateful, harassing or sexual; other people's photos or text without their permission; deliberately false reports; anything that endangers others by misdescribing terrain. Every photo upload and every piece of public text passes an automated safety check, and flagged content is hidden pending review. We may remove content and, for repeated abuse, close the account.

4. The AI features are informational

The App can suggest plans, describe places and identify species from a photo. All of it is informational and can be wrong.

Species identification in particular: never treat it as advice on whether something is safe to eat, touch or use medicinally. The App does not make edibility claims by design, and you should not infer any. Do not eat, handle or apply a wild plant, fungus or animal on the basis of what the App says. Misidentification can be fatal.

5. Points, levels and territory

Experience, levels, badges, streaks, claimed territory and rankings are part of a game layer. They have no monetary value, cannot be bought, sold or transferred, and we may recalculate, rebalance or reset them as the App changes.

Faking activity — spoofing location, importing invented tracks, automating movement — defeats the point and is a breach of these terms. We may remove the affected results and close the account.

6. Fair use of the service

The App is for personal, non-commercial use. Do not scrape or bulk-download our data, do not use automated clients against our API, do not attempt to bypass rate limits or authentication, and do not resell the content. Reasonable per-account limits apply and may change.

7. Availability

Vodach is provided free of charge and as-is. We do not promise it will be available, uninterrupted or error-free, and we may change, suspend or discontinue features at any time. 〈If paid features are introduced, these terms will be updated before they go live.〉

8. Ending it

You can stop at any time and delete your account from the App, from Settings, or at vodach.com/delete-account. We may close an account for a breach of these terms, normally after warning you unless the breach is serious.

9. Liability

In plain terms: we are responsible for running the App honestly and for handling your data as the Privacy Policy says. We are not responsible for what happens on the mountain. If you get lost, injured or stuck, that is not something we can answer for — the route you chose and the decisions you made along the way were yours. Nor can we answer for data we did not write: OpenStreetMap, other users, weather and map providers.

We also do not cover knock-on losses — a missed booking, a cancelled trip, a damaged phone — even where the App misled you.

None of the above touches liability that the law does not allow to be excluded, or your statutory rights as a consumer. If a court finds one of these limits too broad, it applies as far as the law allows and the rest of these terms stand.

10. Changes and applicable law

We may update these terms. Material changes will be announced in the App, and continuing to use it after that means you accept the new version. These terms are governed by Bulgarian law, and disputes fall to the competent Bulgarian courts, without depriving you of the protection of the consumer law of your country of residence.
